1. Who you are contracting with
These Terms govern your use of FocusMVP (the "Service"), provided by Jason Hopper, an individual sole proprietor trading as FocusMVP and operating focusmvp.app (the "Seller"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a school, district, or other organization, you represent that you have authority to bind that organization.
2. The Service
FocusMVP is a teacher-facing application that uses AI to generate classroom focus boards, warm-ups, and exit tickets from lesson materials, and to collect short student responses. The Service is intended for use by educators with appropriate oversight of student data and classroom activity.
3. Acceptable use
You agree not to misuse the Service. You will not, and will not allow others to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- upload content that infringes intellectual property or privacy rights;
- attempt to probe, scan, scrape, or interfere with the Service's security or infrastructure;
- use the Service to generate hate speech, harassment, sexual content involving minors, or other content prohibited by applicable law;
- attempt to circumvent technical limitations, access controls, or rate limits.
4. AI-generated content
The Service uses AI models to generate classroom content from material you provide. You are responsible for the prompts and source material you submit, for reviewing AI outputs before showing them to students, and for ensuring outputs are accurate, age-appropriate, and aligned with your curriculum. AI outputs may be inaccurate or incomplete and are not a substitute for professional judgment. You must have the rights to any input content you submit.
We may remove or restrict content, refuse or filter outputs, and suspend accounts that repeatedly generate prohibited content. We respond to good-faith intellectual property complaints; repeat infringers will have their access terminated.
5. Account and credentials
You must provide accurate registration information and keep your login credentials confidential. You are responsible for activity under your account.
6. Intellectual property
The Seller retains all rights in the Service, including software, design, branding, and documentation. You retain ownership of content you submit, and grant us a limited, non-exclusive license to host and process that content solely to provide the Service.
7. Subscription, billing, and refunds
The Service is offered on a subscription basis with a free trial period. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. Payment terms, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. 8. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination you may export your data for a reasonable period before deletion.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms or the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where excluded by law.
11. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Seller's jurisdiction, without regard to conflict of laws principles.
